I have a business and I pay $4695 monthly rent. The landlord does not issue a monthly rent invoice?

Anyone who understands consumer rights law, kindly help and explain if I have the right to receive a copy of an invoice for my $4,695 monthly rent. I should get an invoice for my record keeping, right?

    What is to say the landlord isn”t declaring all of it if there is a weak or no paper trail? That would be my guess. How does he handle that for tax purposes?

    In most, if not all, states this is an issue that you should have covered in your lease. If the lease doesn’t require an invoice then you are not entitled to it. By the way, consumer rights laws will not help you. You are renting property for the operation of a business. Commercial leases are governed by different law than residential leases, and commercial lease law is much more favorable to the landlord.

    Pay by check, and keep copies of your checks.

    They don’t have to give you an invoice - but you are actually required to issue your landlord a 1099-Misc if you pay more than $600 in rent during the year. You have to keep an accurate accounting of the rent paid so that you can issue the form, which then lets the IRS know they are receiving rental income. Because this is one of those areas where it is hard for them to document income for the landlord, the responsibility falls to the rent payers. Check the 1099 Misc instructions at the IRS website (can’t get the link to go in below right now…)

    Not necessarily, We don’t always give an invoice so what we suggest is that the tenant makes a copy of the check and keep it for their own records.
