Consumer Law: Where Do I Stand With Regards Of This? ?
davie asked:
A few months ago I bought a Sony Bravia TV in a summer sale and it is paid for!
When I paid them I asked them if they would mind looking after it as it was a Christmas/Birthday present for someone. (Myself)
Now it is getting towards the time when I will collect it, but I am having second thoughts as in I want different TV from the same shop.
I want the new style Bravia 2 engine-better picture.
In the next few days I will go in and tell them I will collect it on the 20 December and I will ask them if I can pay the extra for the Bravia 2 engine TV and show my debit card as my way of payment.
(I don’t know how they will react-but I want to forewarned)
Am I within my rights to ask this-or could they be awkward and refuse?
With a recession here/looming I see this as a buyers market and I think they will grab the extra cash I am offering to pay.
The TV is still on their premises so technically the contract between me and the shop has not started (my thoughts on the law??)
Would love to hear any comments on where I stand on the above scenario?
Many thanks

That’s not true. The contract started as soon as you both agreed, those few months ago.
Now do they HAVE to take your new offer? No.
Will they take your new offer? It depends on whether they have a satisfactory sale opportunity for the old Bravia or not. If they do, then they wouldn’t mind selling you the upgrade, but if they’ve kept it for you and lost a chance to sell it to others and now the product is outdated and devalued, then no.
There is only one way to find out. I would prepare myself for the worse and be pleasantly surprised if they allow the upgrade.
Good luck. Hope you end up with the upgrade.
You are perfectly entitled to ask for the upgrade and they are perfectly entitled to refuse, however they are unlikely to refuse making a sale that increases their profit.
One word of warning, I bought one of those TV’s and it was a major disappointment in that the picture gave the impression of being backlit and caused ghosting, a friend also complained that his Sony had the same fault.
as another poster said, your assertion that the contract has not began yet as the TV is still there is incorrect. the contract started when you purchased the TV, period. now, that being the case, the shop has no legal obligation to agree to upgrade you. there is a good chance that they will, if you pay right away for the new TV, and they think that they can sell the old one. however, if the one that you originally bought is a discontinued model, prepare for them to be much more resistant to this as they will basically be stuck with a TV that they then have to unload at a deep deep dish discount.
