[UK] Xbox 360: what rights do I have in law?

A2thT asked:

[UK only] The Sale of Goods Act does not apply between myself, the consumer and Microsoft, since I didn’t buy the console from them. I believe I’m right in thinking that the SoGs Act only applies between a seller and a buyer?

So, what are my rights as against the manufacturer, i.e. Microsoft. Are there any other statutory provisions, or is the issue just left to the general law of negligence?

If no one can answer the law questions, do you know what I can do if Microsoft fail to repair the console when it is still in warranty? What remedy do I have?

Thanks :)

    Sale of Goods Act
Under the Sale of Goods Act 1979 traders must sell goods that are as described and of satisfactory quality.

If consumers discover that products do not meet these requirements they can reject them and ask for their money back providing they do so quickly. Alternatively, they can request a repair or replacement or claim compensation.

The Sale of Goods Act has been amended by the Sale and Supply of Goods to Consumers Regulations 2002 which transpose a European Directive. Although the impact of the Regulations is relatively modest there are some useful benefits for consumers.

Our Traders Guide and Quick Facts page offer further information and advice. Consumer Direct offers loads of advice for consumers who have a complaint under the Act.

I don’t wanna sound negative but if Microsoft said they are not gonna repair it then you are out of luck. You can try to convince them stuff but if they have made it final then that’s pretty much it. As a customer you can do a lot of stuff such as complain to BBB.org, not buy any microsoft product (u might be wondering how the hell would ppl live wihotut a MS/Apple product) and let people know the bad experience you had. I once made a youtube video talking shit about how much that company sucks and stuff like that. Nothing really happend for me but did a lot of damage i hope coz 5000+ ppl watched that vid on youtube. Craigslist.org is an american website but u can try it (search region wise to get ppl from UK) and see if you can find any1 to fix your XB for less (that is of course if your motherboard is not fried or have any severe probs). Repairing would cost u half the price of a new XB so I would suggest getting a new XB from zavvi.co.uk they are selling it under 100 pound. Sorry for writing too many stuff good luck.

without details, no one can say if you are protected by warranty or not. time since purchase is not the only criteria.
