Two weeks ago or so I went to a store and applied for credit , at the store that day I charged approx. $2000.
dan asked:
I THAN RETURNED TO GET TWO COMPUTERS FOR EACH OF MY KIDS , THE SAME SALESMAN WAITED ON ME AND TOLD ME MY CREDIT LIMIT WAS PLENTY HIGH ENOUGH ,SO I CHARGED THEM AND LEFT .
THE COMPUTERS ENDED UP 2 1/2 HOURS AWAY WITH MY KIDS AT THIER MOTHERS HOUSE . FINALLY I WENT TO THE STORE TO PICK UP A T.V. AND FINALLY THE CREDIT LIMIT WAS DONE SO THE SALESMAN CALLED FOR A CREDIT INCREASE AND THAN TOLD ME THERE IS A BIG SCREW UP .
UPON THE FIRST CHARGE HE CHARGED SOMEONE ELSES ACCOUNT , AND MY CREDIT NEVER WHEN THREW IT WAS DECLINED .
SO HE TOLD ME TO RETURN ALL OF THE THINGS OR IT WOULD BE FRAUD .
I DONT HAVE ALL THE THINGS SOME OF THEM ARE INSTALLED - LIKE A DISHWASHER THAT I PAID A BUILDER TO INSTALL , COMPUTERS THAT ARE WITH MY KIDS THAT I REALLY DONT WANT TO GET FROM THEM, AND CAN’T TIL I SEE THEM AGAIN IN THE SUMMER .
WHAT SHOULD I DO ? ISN’T THERE A CONSUMERS RIGHT LAW TO PROTECT ME ?

Are you sure thats how that happened or are you scamming people? And if thats not the case then I would take the person that sold me the things and make him be held responsible.
When you left, you got a receipt and so they essentially signed a contract with you to give you credit. I don’t think they can recind that agreement now. I would keep the items and tell him you intend to pay for the items in accordance with the credit agreement when you took the items. He no longer has the ability to change his mind and they will have to make adjustments due to their clerical mistake. It;s his problem to resolve and not yours. Just be sure to pay monthly etc..
This is what is known as a unilateral mistake on the part of the retailer. If they approved the account for you to make purchases on and you had nothing to do with how they ultimately billed it or who they billed it to, it is not your fault; a unilateral mistake. I would wait until they sent out a summons and complaint and I think that any attorney could exonerate anything you did, or didn’t do, and get the store to take responsibility. As a matter of fact, he could probably just right a letter to them based on the unilateral mistake theory and get them to drop the whole thing.
