Rights of A consumer and where does the law step in?

diane33michigan asked:

when a company refuses to give you any answers, just makes threats and harassing phone calls to family and friends and gives out personal information along with threatening those family members.
I was one month late on my car payment due to my husband losing his job, called company 3 weeks before payment was due and asked if we could defer a months payment, said i had to wait till it was pass due so I called the day after the payment was due, nothing. The Company gave out personal information to my family and friends told them they were going to repo it and everything. My payments are paid all up to date at this time, never had been late not one day before my husband loss job.
How does the law protect me as a consumer? They can sue me if i don’t pay but what can I do to them for release of confidential information ,harassment, and non professional behavior. BBB rating is a F. They do not answer any comments from the BBB. What should be my next steps . They say they will not release title to new company to refinance . Demanded my checking account numbers and I am not on the loan.

If you have a lending institution willing to finance the loan then they cannot hold the title, if they do go to the DMV and they have a division that handles this type of situation.~

Here are two options. Contact your state or provincial department that is responsible for consumer affairs and financial matters. Ideally the one that deals with loans and collections. Tell them you situation. Stick to just the facts. Then file a formal complaint about them threatening your husband and you and other family members. In many jurisdictions it is against the law to threaten during a collection procedure. They are allowed to contact the person owing the debt but not other parties. They can often call numerous times during certain hours which some people consider harassing but it is not by law.

You may want to also check with any state privacy commissioner about them giving out personal information.

You could write them a demand letter telling them to stop calling family members or have the family members do so. If you really want to pull in the big guns hire a lawyer or paralegal to write the letter.

Now I am a little confused. You say that, ‘I was one month late..’ and then say ‘I am not on the loan.’ The persons on the loan should be the only ones that they should be contacting. Good luck
